配偶者就労ビザとは
カナダに滞在する留学生または外国人労働者の配偶者・コモンローパートナーがカナダで就労可能になるビザです。主申請者（留学生・労働者）が勉学や就労中に、家族も同時に働くことができます。
配偶者就労ビザのメリット

配偶者就労ビザの最大の目的は、カナダで就学や就労をする家族のために家計を支えることです。
- 配偶者就労ビザでの就労経験は永住権申請時に就労経験としてカウント。
- 就労状況次第で、雇用先からLMIA就労ビザのサポートを得ることも可能。
- 永住権申請時に主申請者となる可能性もあり、戦略的な計画が重要です。

配偶者就労ビザの申請資格
2025年1月21日より、配偶者就労ビザの申請資格が一部制限されます。以下の条件を満たす場合のみ申請可能です。現在のビザが有効期限内であれば引き続き有効です。
主申請者（外国人労働者・留学生）の条件
- 有効な就労ビザおよび承認レター所持。
- 就労ビザが配偶者申請時点で残り16ヶ月以上。
- TEER 0・1の職種、または指定されたTEER 2・3の職種。
- 就労期間中カナダ居住予定であること。
留学生の場合、以下のフルタイムプログラムに在籍している必要があります。
- 16ヶ月以上の修士課程（Master’s Degree）。
- 博士課程（PhD）。
- TEER 0・1の職種、または指定されたTEER 2・3の職種。
- または、以下の特定の大学プログラム。
- Doctor of Dental Surgery (DDS, DMD)
- Bachelor of Law or Juris Doctor (LLB, JD, BCL)
- Doctor of Medicine (MD)
- Doctor of Optometry (OD)
- Pharmacy (PharmD, BS, BSc, BPharm)
- Doctor of Veterinary Medicine (DVM)
- Bachelor of Science in Nursing (BScN, BSN)
- Bachelor of Nursing Science (BNSc)
- Bachelor of Nursing (BN)
- Bachelor of Education (BEd)
- Bachelor of Engineering (BEng, BE, BASc)
- Francophone Minority Communities Student Pilot
配偶者・コモンローパートナーの条件
- 犯罪歴がない等、労働ビザ一般条件を満たす。
- 婚姻・パートナー関係が本物であること。
- カナダに合法的に滞在中であること（申請時）。
対象職種：NOCのスキルレベル（TEER）2およびTEER 3
配偶者就労ビザの新制限では、主たる滞在者がNOCのスキルレベル（TEER）2または3の職種に就いている場合、その職種が下記リストに該当しなければ、配偶者は申請対象外となります。※2025年1月22日現在

配偶者就労ビザの申請対象外のケース
以下の場合は職種に関係なく申請不可です。
- 難民申請者、退去命令を受けた者。
- 学生ビザとコープビザを保持する留学生。
- 就労ビザなしでキャンパス内外で働く留学生。
- ポストグラデュエートビザ審査中の配偶者。
- 扶養家族である子ども。
- CPTPPや永住権移行のための就労ビザ保持者の配偶者。
配偶者就労ビザの更新条件
留学生がプログラム修了まで追加の期間が必要、または配偶者の就労ビザが主申請者のビザ期間より短い場合、以下の条件で更新申請が可能です。
- 既に配偶者就労ビザを持ち、同じ基準で延長申請すること。
- 延長申請期間が、主申請者の既存の学生ビザまたは就労ビザの期間と一致していること。
配偶者就労ビザの有効期限
主のビザ保持者のビザと同じ日までの配偶者就労ビザが発給になります。
配偶者就労ビザの延長について
カナダ国内滞在中の方で、以下の条件を満たせば延長申請可能です。
- 現在の配偶者就労ビザが主申請者のビザよりも短い場合。
- ビザ期限切れ前に申請すること。
例：主申請者のビザが「2027年3月」まで、配偶者のパスポートが「2026年3月」までの場合：
- 新パスポート取得。
- 新パスポートを取得したうえで、配偶者就労ビザを延長申請。
