What is the Family Class (Spouse/Common-Law Partner)?
This category is for Canadian citizens or permanent residents who want to live with their spouse, common-law partner, or dependent children (including minor biological or adopted children). The sponsor, who must be a Canadian citizen or permanent resident, is responsible for providing the basic needs of the applicant for a designated period to ensure they do not rely on social assistance. During the review process, the applicant may apply for and obtain a work permit.
Who Can Apply for the Family Class (Spouse/Common-Law Partner)
- Spouses married to Canadian citizens or permanent residents.
- Common-law partners who have cohabited with a Canadian citizen or permanent resident for 12 months or more, in a marriage-like relationship.
- Dependent children, including minor biological or adopted children, of the applicant who are either Canadian citizens, permanent residents, or minors of the applicant.
- The sponsor must be a Canadian citizen or permanent resident over 18 years of age and capable of meeting the applicant’s basic needs.
How to Successfully Apply for Permanent Residence?
Preparing Documents to Prove Relationship with the Sponsor
Documents proving genuine marriage or common-law relationship are required. Especially for common-law partnerships, you need to prove that you have been living together in a marriage-like relationship for over a year.
The Main Player is Not the Sponsor but the Foreign National
The main player is the foreign national, not the sponsor. The applicant need to be aware that you are an applicant for permanent resident status yourself and proceed with your preparations without relying entirely on your Canadian partner.
Assessment in the Family Class
The main focus of the assessment is whether the relationship between the sponsor and the applicant is genuine or not. The sponsor’s ability to provide for the applicant’s basic needs is also assessed.
Application Process for the Family Class (Spouse/Common-Law Partner)
01Applying for Permanent Residency to the Canadian Immigration Office
Create an online application portal account for permanent residency, upload all of the necessary documents and submit them to the Canadian Immigration Office.
02Receiving Application Document Receipt Notification from the Canadian Immigration Office
An Acknowledgement of Receipt letter, containing a file number, will be sent by email from the immigration office, and the sponsor’s review begins.Thereafter, the review progress can be monitored by the Tracker service. Applicants will be able to apply for an open work permit during the review period.
03Sponsor Review Approval
The Canadian Immigration Office will send an email notification of the sponsorship approval. The applicant will continue to be reviewed.
04Biometrics (Fingerprint Authentication)
A request letter for biometrics will be sent from the immigration office. If you are in Canada, it will be done at Service Canada, and if you are outside Canada, at the Canadian Visa Application Center.
05Undergoing a Health Examination
You will receive a request letter for a health examination from the immigration office. You must undergo the examination at a medical institution designated by the Canadian Immigration Office.
06Completion of the Canadian Immigration Office Review (Domestic/International)
Applicants in Canada will receive a PR confirmation email from the immigration office and upload the necessary information and photos for the PR card online. Applicants outside Canada will send documents to the designated visa office (for Japanese nationals, Manila in the Philippines) via the Canadian Visa Application Center, and the paper Confirmation of Permanent Residence (CoPR) will be mailed to them.
07Receipt of COPR (Confirmation of Permanent Residence)
You will receive the COPR (Confirmation of Permanent Residence). Residents in Canada download it online, while those outside Canada receive it via the Canadian Visa Application Center.
08Landing
Applicants from outside Canada will enter Canada with the CoPR. Applicants within Canada can complete landing procedures online.
09Receiving the PR Card
A few months after landing, the PR card will be delivered to the designated address in Canada.
Processes (03), (04), and (05) can occur in any order. Sometimes (04) may come before (02).
